Terms of service

1. What the Service is

RealtyAML is software that helps real estate agents, buyers agents, property managers record and manage their obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth): a written AML/CTF program, client identification and risk records, review reminders, reporting timelines, staff training and an audit trail.

2. Not legal advice

The Service is a tool, not legal advice. The AML/CTF program it generates is a template built from your answers. Your firm is responsible for deciding whether it is adequate for your circumstances, for keeping it current, for enrolling with AUSTRAC, for lodging reports on time and for meeting every other obligation under the Act. Where you are unsure, get advice from a qualified professional.

3. Your account

• One account covers one firm. You must give accurate details about your firm and keep them up to date.
• Sign-in is by a link sent to your email address. Keep that mailbox secure; anyone with access to it can access your account.
• You are responsible for what is done under your account, including by your staff.

4. Your data

• Everything you enter, including client identification records, stays yours. We use it only to provide the Service.
• You are responsible for having the right to record and store the personal information you enter about your clients and staff.
• We keep your records for as long as your account exists and, because the Act requires records to be kept for 7 years, we do not permanently delete client records on request during that period. Archived clients leave your register but remain stored.
• You can export your audit trail at any time. If you close your account you may ask us for an export of your data.

5. Subscription and payment

• There is one plan: AU$99.90 per month, including GST, per firm.
• New accounts start with a 14-day free trial. Your card is charged when the trial ends unless you cancel before then.
• Billing is monthly, in advance, through our payment provider. Prices may change with at least 30 days' notice by email.
• You can cancel at any time from the Subscription page. Access continues until the end of the period already paid. We do not refund partial months.
• If a payment fails, we will retry and email you. If it keeps failing, access to the Service may be paused until payment is made; your data is kept.

6. Availability and support

We aim to keep the Service available at all times but cannot promise it will be uninterrupted or error free. We may take it offline briefly for maintenance. Support is by email at hello@realtyaml.com.au.

7. Acceptable use

• Use the Service only for your firm's compliance work and only in a lawful way.
• Do not try to access other firms' data, interfere with the Service, or copy or resell it.
• We may suspend an account that breaks these terms, after telling you why where it is reasonable to do so.

8. Liability

To the extent permitted by law, our total liability to you for any claim connected with the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, including penalties, fines or losses arising from a failure to meet your obligations under the Act. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

9. Changes to these terms

We may update these terms. We will email account owners about material changes at least 14 days before they take effect. Continuing to use the Service after that date means you accept the new terms.
